JAMMU, Sept 12: The Division Bench of the Jammu and Kashmir High Court on Friday grilled the present administration of the J&K Cricket Association (JKCA), the CEO and Administrators, for self-styled functioning.
The court was responding to the miscellaneous application filed by the Board of Control for Cricket in India (BCCI) and JKCA in a LPA 14/2019 along with connected matters.
The Chief Justice of the J&K High Court , Justice Gita Mittal, while hearing the case on virtual mode with JKCA counsel joining from New Delhi, snubbed the JKCA for prolonged stay in the cricket body and further questioned the role of Judges in cricket activities, with further attempts to bring in a change in the basic membership structure of the Association.
“It is praise worthy on part of the Chief Justice that her ladyship was aware of the happenings over the functioning of the sports activities by JKCA, especially when she snubbed the JKCA counsel on performance comment, when he tried to maneuver the Court by saying that after association was taken over by the CEO and administrators JKCA, the teams have performed well. Her Ladyship while rejecting the claim of JKCA counsel, categorically mentioned and praised the players of J&K being very talented and for performing without even due resources,” informed Advocate Achyut Dubey, who is also the arguing counsel in two of the clubbed cases from Jammu.
He further said that the way proceedings of the court took place and apex cricket body in India, the counsel for BCCI unfolded the uncalled for acts of JKCA based on facts, the Division Bench may come out with a judgment in favour of the BCCI.
Pertinent to mention here that the BCCI has requested the JKHC in its detailed application as a response to the petition that the parent cricket governing body in India (BCCI) wants an adhoc committee consisting of a former Indian cricket team Captain to govern and develop JKCA, in place of the highly expensive CEO and the Committee of the Administrators, who were appointed only for a period of two months for a particular task to conduct the apex counsel election by amending rules at par with the constitution of the BCCI.
As per the BCCI, the CEO and Administrators JKCA have gone beyond the scope of Lodha Panel in as much as have even undermined the directions of BCCI and framed the constitution to favour their own oblique motive, which the BCCI has never approved.
Looking at the gravity and seriousness of the case, the case has been listed for next week and the date of hearing is on September 18 (Friday), for arguments.
