Continuing his battle and taking it step forward Australia top pacer Mitchell Starc has submitted video evidence as part of his battle to get insurance payout from the insurers for the injury he suffered and subsequently missing big money IPL contract.

Starc was grabbed by IPL franchise Kolkata Knight Riders (KKR) for INR 9.40 crores for the 2018 edition. However, he couldn’t take part in the same due to a right leg injury.

Starc filed a lawsuit against his insurers in April last year. The insurers, however, had disputed the timing of the injury in second Test at Port Elizabeth.

The ‘Sydney Morning Herald’ has reported that civil trial has been rescheduled to August 12 after mediation talks broke down last month when Starc’s manager Andrew Fraser provided footage from Fox Sports of the speedster bowling in the second Test.

It was in the Test tour of South Africa in March 2018 that Mitchell Starc suffered the injury. He went through the casualty in the second Test in Port Elizabeth for which Starc lodged a lawsuit against his insurers in April last year. However, the insurance company argued over the timing of that injury. The insurance payout amounts to $1.53 million.

The insurers stated in their defence that the clips provided initially did not give them enough time to assess the injury from the 10th of March in 2018. The first clip was of 1 minute and 37 seconds and the second was of 7:25 minutes. Nevertheless, the paceman’s legal team bought 13 months for themselves to review the case and produce valid footage. Mitchell Starc was required to furnish a video of his injury suffered in real-time to stand any chance of getting the insurance payout.

The 29-year old left-arm pacer’s orthopedic surgeon Russell Miller stated that “the injury was “complex and multifactorial” but “it is likely, on the balance of probabilities, that at specific injury occurred on 10/03/2018 which was associated with extreme physical activity including bowling on a pitch with ‘uneven footmarks’.”

On behalf of insurer’s doctor Seamus Dolton said “In my opinion the plaintiff did not suffer an injury or accident on 10 March 2018. Mr Starc became aware of the onset of right posterior and posteriolateral calf pain during the course of the second Test. Onset appears to have been gradual and symptoms continued over the course of the Test.” as quoted by India Today.
